These terms govern use of My-AI Assistant ("the application"), private software developed and operated by Karl Botha, trading as IQ Draughting, South Africa ("the developer").

Nature of the software. The application is private, single-user software that runs on the developer's own computer. It is not sold, licensed, distributed, or offered to the public, and no third party is invited or permitted to use it.

1. Scope and eligibility

The application is operated solely by its owner, on hardware they control, using their own Google Account. There are no user accounts, no registration, no subscription and no fee. Nothing in these terms constitutes an offer of service to any other person.

2. What the application does

It assists with personal and professional work on the owner's own material: searching and summarising email, calendar and documents; extracting and answering questions about technical documents; drafting text; and running background research and analysis tasks. Language processing is performed by a model running locally on the same computer.

3. Authorised use

The owner agrees to use the application only for lawful purposes and only with data they are entitled to access. In particular, the owner is responsible for ensuring that any document ingested into the application is one they hold the necessary rights or licence to use in that way. Published standards and other copyrighted works may carry terms restricting such use.

4. Google account access

Access to Google services is granted by the owner through Google's OAuth consent screen and may be withdrawn at any time at https://myaccount.google.com/permissions. Handling of that data is described in the Privacy Policy at https://www.iqdraughting.com/privacy-policy, which forms part of these terms. Use of Google APIs is additionally subject to Google's own Terms of Service (https://policies.google.com/terms).

5. Actions that change your data

The application can send email, apply labels, archive or trash messages, create calendar events, and create or modify files. Actions that send, delete or overwrite require a separate confirming step and are not performed on the model's initiative alone. Even so, the owner remains responsible for reviewing anything the application proposes before confirming it.

6. Accuracy, and the limits of automated analysis

The application produces summaries, extractions and analyses, including of technical and regulatory documents, using automated methods that can be incomplete or wrong. Optical character recognition can misread a scanned table. A retrieved clause may not be the governing one. A cited figure should be checked against the source.

Output is a working aid and is not professional, engineering, legal or compliance advice. It must not be relied upon as a certification of compliance with any standard or regulation. Any conclusion that matters must be verified by a competent person against the authoritative source document.

7. No warranty

The application is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. The developer does not warrant that it will be uninterrupted, error-free, or that any defect will be corrected.

8. Limitation of liability

To the fullest extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or business, arising out of or in connection with the application or its output, whether based in contract, delict, negligence or any other theory, and whether or not the developer was advised of the possibility of such damage.

9. Availability and changes

The developer may modify, suspend or discontinue the application, in whole or in part, at any time and without notice. These terms may be revised; the effective date above will be updated and the revised terms published at this same address.

10. Governing law

These terms are governed by the laws of the Republic of South Africa, and the courts of South Africa shall have exclusive jurisdiction over any dispute arising from them.
